Gift Card Terms & Conditions
General Terms
Scope
These Terms and
Conditions ("Terms") govern the purchase, delivery, use, and limitations
of Amsterdam gift cards ("Gift Cards") issued by Amsterdam Brewing
Co. ("Amsterdam").
By purchasing and/or
using a Gift Card, the purchaser agrees to have read and to be bound by these
Terms.
Purchase
conditions, value, redemption and use:
Amsterdam Gift Cards
are available for purchase as physical cards or digital e-cards. There are two
types of Gift Cards:

Regular Gift Cards (physical
or digital): No dormancy fees or expiration dates apply for these Gift
Cards.

Promotional Gift Cards: If
a promotional Gift Card is issued, the Gift Card will feature a "Reverse
transaction for expired cards" setting. Meaning that when the designated
expiration data is reached, the funds will automatically be emptied. No
dormancy fees apply for these promotional Gift Cards.
The Gift Cards are issued in specified values and may be redeemed up
to their remaining balance. The Gift Card cash balance is redeemable for food,
beverages, merch and gratuity at Amsterdam Brewhouse, Amsterdam Barrel House,
Amsterdam Brewmarts and amsterdambeer.com.
Amsterdam is not
responsible for any unauthorised use of Gift Cards, for lost or stolen Gift Cards,
or for any issues or liabilities arising from adding Gift Cards to digital or
mobile wallets not owned or operated by Amsterdam.
Amsterdam Gift Cards
have no value until activated and will require the personal identification number
(“PIN”) attached to the original Gift Card purchase for redemption. The
PIN will be sent to the cardholder in an email.
Gift
Cards may be purchased without age restriction where no personal information is
collected at the point of sale.
Notwithstanding
the foregoing, participation in any loyalty or registered programs offered by Amsterdam
is limited to individuals who are at least fourteen (14) years of age, in
accordance with Data Candys privacy and data protection obligations.
Gift
Cards may not be used by minors to purchase alcohol or any other goods or
services that are subject to age-based legal restrictions. Amsterdam reserves
the right to require valid government-issued identification at the time of
redemption and to refuse any transaction that does not comply with applicable
laws and regulations.
Amsterdam
further reserves the right, in its sole discretion, to refuse, limit, or cancel
any Gift Card purchase or redemption for purposes of fraud prevention, legal or
regulatory compliance.
Permitted
payment methods include credit cards, debit cards, and other approved
electronic payment methods. Amsterdam does not accept cash payments.
Amsterdam reserves
the right to refuse or limit purchases.
Delivery
A Gift Card may
be purchased either as a physical Gift Card or a digital Gift Card.
To purchase a
Physical Gift Card, visit, Amsterdam Brewhouse, Amsterdam Barrel House, or Amsterdam Brewmarts.
The digital Gift
Card can be purchased through Amsterdam’s website and is delivered via email
Amsterdam is not
responsible for incorrect delivery details provided by the purchaser or digital
errors.
Balance
Inquiries
Cardholders
may check the balance of their Gift Card at any time via Amsterdam online
balance check portal, available at: Amsterdam Brewing Balance Checker.
Amsterdam
does not charge any fees for balance inquiries.
Lost or
Stolen Gift Cards
If you, as the cardholder,
suspect that someone has copied or stolen your Gift Card, please contact
Amsterdam Brewhouse Customer Support immediately on brewhouseinfo@amsterdambh.com
or call 416 504 1020.
Gift Cards which
are lost, copied or stolen will not be replaced if without proof of original
purchase. Purchased Gift Cards have cash value and should be safeguarded
accordingly.
Amsterdam
does not charge any fees in connection with lost or replacement Gift Cards, and
cardholders will not be subject to any administrative, replacement, or transfer
fees in the event a Gift Card is lost.
Where
a Gift Card is reported lost, Amsterdam will arrange for the transfer of the
full remaining balance and associated transaction history to a new, unused Gift
Card. The original gift Card will be deactivated and marked as “Lost.” No fees
of any kind will be applied in connection with this process.
The
inclusion or exclusion of such fees is at the sole discretion of Amsterdam, and
Amsterdam has elected not to impose any such charges.
Purchased Gift Cards
have cash value and should be safeguarded accordingly.
Limitations
You can not use
an Amsterdam Gift Card to purchase other Gift Cards.
Gift Cards are
non-refundable and cannot be resold, transferred for value, or redeemed for
cash, except to the extent required by law.
Gift Cards may
become void if resold, transferred for value, or redeemed for cash unless such
resale, transfer or redemption is required by law.
Unused Gift Cards
may not be transferred by cardholders, except as otherwise arranged by Amsterdam
in connection with a lost or stolen Gift Card claim under these Terms.
Amsterdam is not
obliged or responsible for honouring a Gift Card purchased from an unauthorized
vendor nor is Amsterdam responsible for any loss incurred by a purchaser acquiring
a Gift Card from unauthorized vendors.
Gift Cards
purchased or bartered from sources other than Amsterdam may not be valid or
redeemable or may have been duplicated or previously redeemed.
Amsterdam may
suspend Gift Cards in cases of fraud or misuse or suspicion hereof.
Liability for Amsterdam
is limited to the fullest extent permitted by applicable law.
Promotional
or Bonus Gift Cards
In limited
circumstances, Gift Cards provided as promotional, bonus cards, value or
otherwise for promotional purposes may contain an expiration date.
Notice of expiry
date will be given at the time of purchase and displayed on the Gift Card.
Promotional or
bonus Gift Cards have no cash value, and Amsterdam is not required to honour or
accept any promotional or bonus Gift Card that has expired.
Validity and
Expiry:
In accordance
with the Ontario Consumer Protection Act, 2002, Gift Cards do not expire, and
no activation fees apply (subject to legal exceptions).
Amendments
and notice
Amsterdam may amend these Terms by providing
notice via its website, at point of sale, or by email. Unless otherwise stated,
amendments will apply to both future and existing Gift Cards; provided,
however, that no amendment will reduce the outstanding balance on any
previously issued Gift Card or impair the right to redeem that balance in
accordance with these Terms (as amended). Amsterdam will post the amended Terms
at https://amsterdambeer.com/gift-card-terms-conditions/ at least thirty (30) days before the amendments take effect
("Notice Date"). During the thirty (30) day period following the
Notice Date, Amsterdam will also post a notice at https://amsterdambeer.com/gift-card-terms-conditions/
indicating that
the amended Terms have been published and will take effect at the end of that
period. Any amendment will become effective thirty (30) days after the Notice
Date. You are deemed to accept the amendments if: (1) you do not notify
Amsterdam to the contrary in writing within thirty (30) days of the Notice
Date; or (2) you continue to use any Gift Card after thirty (30) days of the
Notice Date. If you notify Amsterdam in writing that you do not accept the
amendments within thirty (30) days of the Notice Date, Amsterdam will cancel
your Gift Card and refund any remaining balance to you.
Personal
Information
Upon purchase of
a Gift Card personal information will be collected and processed by Amsterdam
and DataCandy (division of Paystone Inc.), the Gift Card issuer used by
Amsterdam. By purchasing the Gift Card, you consent to such processing with the
regulation in force regarding proception of personal data. The personal data
will only be used for the purposes of carrying out and registering the Gift Cards
and, if your consent is obtained, to send you emails containing news and offers
from Amsterdam.
The personal
details will at all times be kept confidential and in accordance with the Quebec’s

Governing Law
These Terms are
governed by the laws of the Province of Ontario, Canada, with jurisdiction in
Toronto.
